Not only are the Kellers, having nowspent two decades in prison, innocent —none of the alleged crimes ever happened. Fevered FantasiesI write that bluntly, but with bitter resignation.

Icertainly hope the appeal is successful, butprosecutors — current Travis County DistrictAttorney Rosemary Lehmberg was incharge of the child abuse unit at the time —are notoriously reluctant to acknowledgemistakes, and even in matters of actualinnocence, the courts are extremely slow toact upon error, often preferring finality tojustice. And some of the people involved, who led small children into a web of absurdfantasies, continue to insist that the Kellersare guilty.

Unfortunately, Austin will notbe able to say that with a good conscienceuntil the Kellers are out of prison. Mob madness is never very far away. This is not spirited, necessary debateabout disputed public policy.

The Keller case and its nationwide kin, like the current gun hysteria, serve aspainful reminders that irrationality andmob hysteria are never far beneath thesurface of public life.

Much more disturbingis that officials charged with publicsafety and the due process of law should beso gullible as to accept the wildest, impossiblefantasies as credible allegations, andshould fall prey to the very madness thatit is their responsibility to prevent.

The initial rezoningrequest was made in September ,and the case finally arrived at Council forthe last meeting of Dec. The projectwill encompass the historic Bosch-Hoggbuilding next door, preserving its facade.

For someone hoping to build a multimilliondollar project, Kahn does a fairly convincingjob of portraying himself as aneveryman oppressed by forces far morepowerful. What makes this project different? The major bone of contention is the factthat the proposed design would violate thefoot setback requirements on the westside of Congress which require buildings tostep back 60 feet from their facades after theinitial 90 feet. Kahn proposes a tiered designthat would step back 15 feet after the first 45feet of facade, then another 15 feet after anadditional 45 feet of elevation.

In September , the board of the DAAunanimously agreed to support the zoningchange and the increased floor-to-area ratio which allows greater height. The DAAwarns that violating the setback would becatastrophic, because the resulting competitionfor Capitol views would eventuallycreate a narrow canyon from Lady BirdLake to the Capitol Building.

Since then, the overlay andits required setbacks have been observedon the west side of Congress. The DAAmockup used to illustrate the visually dystopianhorror that awaits Downtown wascreated by mirroring the east side of theavenue onto the west. Meanwhile, the Downtown Austin NeighborhoodAlliance has endorsed the project, saying that it would activate a key part ofCongress Avenue while preserving thefacade of the historic Bosch-Hogg building. DANA is careful to state that its support ofthe project does not indicate a blanketacceptance of relaxing the Congress AvenueOverlay.

Kahn points outthat the plan suggests the city considerrelaxing the foot setback, acknowledgingthe impossibility of developing the westside under current standards. In previous discussions, there was some nervousnessexpressed concerning safety and consequent liability issues— the hope is a pilot will help determine whether such a programcan fit into the in-progress Urban Trails Master Plan. On a symbolic but potentially national level, CM BillSpelman proposes Item 53, seconded by Tovo andMorrison, and likely to pass by acclamation formally supportinga constitutional amend ment or other legislation aimed atoverturning the U.

Somewhere between symbolicand eventually actionable are a couple of other proposals. Item 61 SherylCole would pursue whether to return to the voters foraffordable housing bonds — the only bond initiative rejectedin the November election. The proposal is co-sponsored byj o h n a n D e r s o nItem 51 from ChrisRiley proposes a oneyearpilot programallowing hourhiking and bikingon three greenbeltsaround town. Spel man and Riley, but othermembers have expressed skepticismover bringing back soquickly a rejected proposition.

The draft resolution rests on theargument that the successful bonds leveraged muchfederal matching money, havebeen exhausted, and could bereissued without raising theproperty tax rate — but that maystill be a hard sell so quicklyafter a public defeat. Opponents respond that the overlay remainsin effect as is.

Appeal Filed in Day Care Abuse CaseAn appeal filed Monday morning inTravis County district court reopens aninfamous chapter in Austin history and setsout to prove, once and for all, that formerOak Hill day care operator Frances Kellerwas wrongfully convicted of sexual assaultand has spent the last 20 years behind barsfor a crime that never happened.

After a day at theKellers in the summer of , Christy toldher mother, Suzanne Stratton, that DannyKeller had spanked her; that allegationquickly morphed into an allegation of sexualabuse. According to the page writ filed thisweek by veteran Austin defense attorneyKeith Hampton, those key pieces of evidencehave now been discredited. Although the children saidthey were filmed or photographednumerous times duringthese ritualistic and sexualassaults, the only physical evidencethat prosecutors broughtto court was a medical assessmentperformed by a youngER doctor, Michael Mouw.

Stratton brought her daughterFrancesKellerto Brackenridge one night after catchingChristy crying in the bathroom.

Mouw told us in that he learned laterthat what he saw was likely not an injury. Rick Perry has said he wants more taxcuts. The hardliners failed to pass amendments that would tie the hands of committee chairs bycreating new paths to fast-track controversial bills out of committee. However, Rep. Phil King,R-Weatherford, found support to rewrite points of order, meaning bills could no longer be derailed justbecause of small technical and grammatical errors.

In a genius flourish of political ju-jitsu, King remindedDemocrats that this would be a return to the s rules of Democratic Speaker Pete Laney. When they return, the toporder of business will be the drawing of Senate terms. However, since they are held for staggered four-year terms, with halfthe seats on the ballot every two years, senators have to draw balls to see who gets the full four years andwho will be running for re-election in While no one wants to pull a two-year term, ambitious lawmakerseying higher office in , like governor or attorney general, are much more likely to risk a statewiderun if they know their senate seat will still safely be there for them if they lose.

In court, police testified extensively aboutusing an infrared-equipped helicopter tosee below the surface of the Oliver Cemetery. Butwhat police failed to mentionwas that the cemetery caretaker,Frances Balta, told policein that there was no evidencethat any graves in thecemetery had been disturbedat all, and that there were perfectlynatural reasons that severalgraves appeared disturbed, such as erosion or theaddition of new dirt to a sinking plot.

Locally, too, Austin municipalities arejockeying for position. On Tuesday, however, commissioners decided to maintain the currentcontract with Saxet Gun Shows through Word is that they will continue toreview the matter.

Austin City Council Member Laura Mor rison— who sits on the PHHS Committee withMartinez and Chris Riley — requested that ittake up the issue, and in principle is lookingtoward something beyond a gun show ban, from a public health perspective.

Also playing a role in all of this is thenational bank of gun enthusiasts. Tovothought it worrisome enough to check inwith her colleagues about the call. Frightened animals fleeinto the woods, even though nothing seemsto be chasing them. Nature has turned topsyturvy. It can mean only one thing: The Legislature is back in session.

TakeGeorge Lavender. Yes, please. This right-wing peer of thelower chamber became a hero of the kookycaucus in by sponsoring and passing abill intended to save us Texans from anunspeakable horror: energy-efficient lightbulbs. Because of a federal law enacted by that notorious lefty presidentGeorge W. Bush , lightbulbmakers wererequired to produce high-efficiency bulbs toreplace the old energy suckers. The only public official not playing his orher presumed role might be Land Com missionerJerry Patterson.

Patterson, who hasalready announced a run for lieutenant governor, called Austin Mayor Lee Leffing wellwith one potential solution: Offer gun showattendees a one-card-serves-all opportunityto get a background check at the entranceto the event. If you pass, you can buy all theguns you want and can legally own.

If youfail, no can do. As for his own views, the mayornoted that he is on record along with hundredsof mayors nationwide, via MayorsAgainst Illegal Guns for stronger federalrestrictions on ammo clips and strengthenedbackground checks. Still, Leffingwell could well entertaina move to take action locally.

Itwould also represent a rare instance of astate-level political power-player reachingdown to help the city of Austin. Not that any of it will ward off continuedstrong opposition from the gun lobby, or thelegislators and state-level executives whopay it homage. At least, if the likes of Abbottcontinue to play their assigned roles. It washis Alamo moment, as he rose in defense ofthe holy right of Texans to waste as muchenergy as we damn well please.

Where else but Texas? Imagine how proud DavyCrockett would be to know thathe died to make this possible. Unfortunately for Lavender, major bulbmakers were alreadyprofiting from the burgeoning conservationmarket, so they had no interest in goingbackward.

In , Perry designated an ultrasound-before-abortionbill an emergencyitem, touching off a protracted legislativebattle. The law eventually passed, requiringwomen seeking an abortion to first undergoan invasive, narrated ultrasound procedure.

As of press time, Perry spokeswomanLucy Nashed said there were as yet noannouncements to be made on potentialemergency items. At that rally, Perry oftendelivers his most pointed attacks on reproductiverights. Mostobviously, the family planning and basicreproductive health services budget meantto serve low-income, uninsured Texaswomen was all but destroyed in As aconsequence, dozens of veteran family planningproviders closed, and more than ,women lost access to basic health care.

Neither the fact thatpregnant women are ineligible for the WHP,nor that none of the PP clinics involved in itactually provide abortion services, has dissuadedTexas officials.

That rule change — which is contrary tofederal law — resulted in the feds pulling allfederal funding for the WHP. Meanwhile, more than 40, additional women will nolonger be eligible for state health servicesunless they leave Planned Parenthood andchoose a state-approved provider.

The newrules have also kept the state involved inlitigation for more than a year, defendingits right to choose the health care providersfor low-income women. The efforts shared thecommon political goal of defundingPlanned Parenthood. Since , thosefunds had provided screenings for cancerand related health concerns, testing andtreatment for sexually transmitted diseases, and birth control supplies for , lowincomeand uninsured women and men ayear.

The ultimate intention, of course, was thatthere would be no funding left for any TierThree clinics. Hardware to western wear, Feed toseed and everytHing in between! One direct consequence of thesemassive statewide cuts is a spike in thenumber and public cost of unplanned pregnancies;because of the family planningcuts alone, the state is anticipating the birthof roughly an additional 23, Medic aidpaidbirths that would not have occurredhad the women had access to birth control.

Although some lawmakers insist thatprioritizing FQHCs is a better use of funds, that change has neither expanded servicesnor saved the state any money. Should a woman come in for birth control, for example, the FQHC must also provideother services like dental, without regard tocost. Dawnna Dukes. Since the funding cuts, 13Texas PP clinics have closed and possibly a14th in San Antonio , leaving 63 in operationacross the state.

But because of the fundingcuts, a greater number of non-PP providershave either closed their doors or reducedtheir hours and the number of clients theyserve. In all, as of this past fall, 54 providershad shut their doors — including 28 publicand private comprehensive health providersand 13 non-PP specialty family planningclinics.

According to testimony last week byUT- Austin sociology Professor Joseph Potter, another six clinics have since closed, bringingthe total to In all, more than , people lost accessto health care last year.

Whether thatmoney will remain, or even help, remains tobe seen. WHP rules had longincluded a prohibition on using abortionproviders, but that clause had never beforebeen used as a wedge to force out PP clinicsthat do not provide abortions. Under federal law, women have the rightto see the qualified provider of their choice, and former Health and Human ServicesCommissioner Albert Hawkins knew that tointerpret WHP rules otherwise would jeopardizethe federal funding.

State officials spent more than a yearcrafting language to do just that — and thesame amount of time defending their right todo so in federal and state courts. Balquintalives in McAllen, where she works parttimeas a sexual violence prevention educationcoordinator. The suit argues that the exclusion conflicts withstate laws that, like federal law, prohibitdiscrimination among providers. The suitalso challenges a poison-pill provision inthe rules that would kill the program altogethershould PP prevail in court — a provisionadded by state health departmentofficials without the consent of state lawmakerswho last session rejected such adrastic measure.

Should the state prevail and PP be barredfrom participation, it appears that there willsimply not be enough providers to absorbthe more than 40, women left withoutaccess to their provider of choice — let alonetake on additional clients should the programcontinue to grow. In , 91,women were enrolled; by , that numberhad grown to , Not all of the womenwho could seek service actually do so in agiven year; in , the number whoreceived services declined slightly — from, in FY to , in FY Locally owned.

Now that the state isfunding the once-Medicaid-funded program, Yelenosky said, there is lesslikelihood that Planned Parenthood will prevail on the merits of the case one of the elements required for issuing a temporary injunction. Federal Medicaid law prohibits discriminationamong qualified providers. The other 16 WHPproviders within 30 miles of Abilene saw acombined total of clients, and the seventhat actually responded to theHHSC survey saw just clients in Nonetheless, the seven providers now projectthat together they canserve 5, TWHP clients in Not just astonishing.

In dumping PP from the program, the state is orphaning morethan 40, women who had been receiving services at PP clinics, although it insists other providers can fill the gap. Donna Howard D- Austin. Whilemoney may be found — in federal fundsstripped from the budget last year andmoved to other programs — it seems unlikelythat those funds would be given back tothe family planning budget without restric-placed on providers — that is, PlannedParenthood.

Known as Title X money from thefederal legislation , this is the only pot offunding that lawmakers were unable todivert to other programs last year, becausefor four decades this money has been earmarkedspecifically for family planning. But Title X funds need not go directly to thestate government: In a number of states —including California, Utah, Iowa, Ohio, andIllinois — the federal government grantsTitle X money directly to PP or anothernonprofit provider, which then administersthe grant and distributesfunds to qualified providersacross those states.

Hagerty has beenworking for months with hercoalition of providers on aplan to take all Title X moneyearmarked for Texas — moneythat over the last few yearshas gone directly to DSHS,with its disbursement subject to prevailingpolitics at the Capitol.

AC: What do you get from having your studio space as yourhome space?

WH: Well, it makes sense with my practice. I liketo make objects that fit in the space of everydaylife — objects that sit oddly in the home. Forexample, this [pointing at a centerpiece onhis dining room table] takes the place of anobject in the home such as a bowl of fruit, which signifies that a space is decorated.

In this way,I carry a whole history of installation work. What did you do for that? WH: Well, outside is a big paper moon, which I got offCraigslist. It was from a wedding. For some reason I oftenend up with leftovers from weddings.

WH: Yes, a lot of temporary objects. WH: I think something like the moon has a shelf-life thatkeeps halving itself. So, soon. So it seems too good to be truewhen the mayor of New York Crowe personallyhires Taggart to track down the lover ofhis wife Zeta-Jones two weeks before heruns for re-election. ButTaggart refuses to limit himself to matters ofthe boudoir. The plot, frankly, is a little confusing. But all ofthis cartoony nonsense must be forgiven, because Hughes manages to accomplish afeat I would have never thought cinematicallypossible: He creates a white-knuckle scenefrom a mayoral debate about zoning policy.

Quentin Tarantino is back with another whip-smartwish-fulfillment history adventure. The love story, in which the former slave Django Foxx seeks to rescue his wife Broomhilda Washington from the plantation owner to whom she was sold, isvivid and palpable.

Eventhe comedy has its moments to shine. As entertainingand eye-opening as Django Unchained is, the film alsosuffers from a certain slackness. Toward the end ofthe two-hour-andminute epic, the film seems readyto conclude — but not before Tarantino stages anotherobligatory, Mexican-standoff flourish.
